INTRODUCTION

Welcome to The Rook’s Chess Academy, operated by The Rook’s Chess Academy. The terms “The Rook’s Chess Academy,” “us,” “we,” “our,” and “the Academy” refer to The Rook’s Chess Academy as an educational service provider.

By engaging with us, including using our website www.therookschessacademy.com, participating in sessions through Zoom, Lichess, Chess.com, ChessBase, WhatsApp, or any other third-party platforms we utilize (collectively, the “Services”), you agree to be bound by these Terms of Use (“Terms” or “Agreement”).

We reserve the right to modify or update these Terms at any time. Any significant changes will be posted on this page along with the effective date. Your continued use of our Services after any changes constitutes your acceptance of the updated Terms.

ELIGIBILITY TO USE OUR SERVICES

By using our Services, you represent and warrant that:

a) You are not barred by any applicable law from using educational or digital services.

b) You have not committed any felony or offense involving violence, children, or sexual misconduct.

c) You are not registering under false credentials or after a previous ban without explicit permission.

You agree not to:

a) Violate any applicable laws or regulations.

b) Provide false or misleading information.

c) Harass, threaten, or misuse any user or staff.

d) Use another person’s account.

e) Copy or distribute proprietary content without our written consent.

f) Inject malicious code or reverse-engineer our systems.

g) Use our Services for any unlawful, unethical, or disreputable purposes.

h) If under 18, you confirm that your parent or legal guardian has reviewed and consents to these Terms on your behalf and takes full responsibility for your use of the Services.

CONTENT

3a. Your Content

You are responsible for any content (text, images, audio, video, or other material) you submit. By submitting content, you grant us the right to use, publish, or feature it on our website, social media (Facebook, Instagram, etc.), and learning platforms.

This includes participation in programs like:

a) Parents Kids Competitions

b) Rook’s Inter Academy Challenge

If you do not wish to be featured, notify us in writing at [email protected].

We may review or remove your content at any time at our discretion.

3b. Our Content

All intellectual property, including lesson content, images, videos, branding, and educational material, is the exclusive property of The Rook’s Chess Academy. You may not copy, redistribute, or alter it without our written permission.

Content containing or promoting the following is strictly prohibited:

a) Harassment, hate speech, obscenity, or violence

b) Nudity or sexually explicit material

c) Drugs, vulgarity, or discriminatory behavior

d) Viruses or disruptive software

e) Commercial advertising without our approval

f) Violation may result in immediate account suspension without refund.

PRIVACY

We value your privacy. Our Privacy Policy outlines how we collect, use, and store personal information. By using our Services, you agree to its terms.

LICENSE GRANTED TO YOU

We grant you a limited, non-transferable license to use our Services for personal, non-commercial learning purposes, subject to these Terms.

LICENSE GRANTED TO US

By submitting content, you grant us a worldwide, royalty-free license to use, publish, display, reproduce, or modify it for educational and promotional purposes.

This includes your name, image, chess games, and testimonials.

PURCHASES, SUBSCRIPTIONS & CANCELLATIONS

Our classes are offered via subscription (private or group). All payments are processed through your chosen method and renew automatically unless cancelled.

We may record sessions via Zoom for quality or marketing purposes. Participation in a recorded session implies consent. Do not share sensitive personal information during such sessions.

Canceling your subscription only ends future payments. You will continue to have access to remaining classes. To cancel your subscription or delete your account, contact: [email protected]

Important:

a) Your subscription is with The Rook’s Chess Academy only.

b) If your account is terminated, your access to associated platforms may also end.

NO REFUND POLICY

The Rook’s Chess Academy follows a strict no-refund policy. By subscribing, you agree that all payments are final.

CONTESTS & AWARDS

We may host competitions such as the Rook’s Inter Academy Challenge. Winners may be publicly featured on our platforms. Participation is optional.

TERMINATION

We reserve the right to suspend or terminate your account for any violation of these Terms. Termination does not entitle you to a refund.

COMMUNICATIONS

You consent to being contacted via WhatsApp, text message, or email for updates, alerts, and promotional content. You may opt out by replying “STOP” or contacting [email protected].

BACKGROUND CHECKS

While we take steps to ensure instructor credibility, we do not independently conduct criminal background checks. We are not liable for any instructor or student conduct on or off our platform.

DISCLAIMER

All services are provided “as is.” We make no warranties regarding availability, accuracy, or safety of our Services. Use of our Services is at your own risk.

We are not liable for any loss, injury, emotional distress, or damages arising from the use of our Services or interactions with other users.

THIRD-PARTY TOOLS & PLATFORMS

We use platforms like Zoom, Lichess, Chess.com, WhatsApp, and ChessBase. By using them, you agree to their respective terms and privacy policies. We are not

responsible for third-party tools' performance or data handling.

LIMITATION OF LIABILITY

Our liability is limited to the amount paid by you for our Services. We are not liable for indirect, incidental, or consequential damages.

GOVERNING LAW & DISPUTES

These Terms are governed by the laws of India. Any disputes shall be resolved under Indian jurisdiction, subject to applicable consumer protection laws.

INDEMNITY

You agree to indemnify and hold harmless The Rook’s Chess Academy and its team from any claims, liabilities, or damages arising from your actions or content

submitted.
